Americ LLC Messaging Terms & Conditions

1. Consent to Receive Messages

By opting into the messaging program, you consent to receive recurring automated promotional and personalized marketing text messages (e.g., SMS and MMS) from Americ LLC. These messages may be sent using an automatic telephone dialing system to the mobile phone number you provided at the time of opt-in or any other number you designate.

Your consent to receive these messages is not a condition of any purchase. Message and data rates may apply.

2. Message Frequency

Message frequency may vary. Americ LLC reserves the right to alter the number of messages sent at any time to increase or decrease the frequency of communication. Additionally, we may change the short code or phone number from which messages are sent and will notify you if such a change occurs.

3. Message Delivery

Not all mobile devices or handsets are supported, and our messages may not be deliverable in all regions. Americ LLC, its service providers, and participating mobile carriers are not liable for delayed or undelivered messages.

4. Carrier Support

Our messaging program supports the following carriers:

  • Major Carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, Virgin Mobile.

  • Other Participating Carriers: Alaska Communications Systems (ACS), Appalachian Wireless, Bluegrass Cellular, Cellular One (various regions), Cincinnati Bell Wireless, Cricket, Coral Wireless, COX, Element Mobile, GCI, and more. Carrier participation is subject to change.

5. Opt-Out and Cancellation

You may opt out at any time by texting one of the following keywords: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to our short code. After doing so, you will receive a confirmation text indicating that your request has been processed.

If your opt-out message does not include one of these specific keywords, our system may not recognize the request, and Americ LLC and its service providers will not be held liable for unprocessed requests.

To stop receiving messages from other programs you’ve joined, you must unsubscribe separately from those programs.

7. Privacy and Data Protection

We value your privacy. Americ LLC does not share, sell, rent, or trade SMS opt-in data or personal information with third parties for marketing purposes. Your data is only shared as necessary to provide messaging services.

8. Dispute Resolution

General Agreement

All disputes arising from these Messaging Terms or your receipt of messages from Americ LLC will be resolved through binding arbitration in accordance with the Federal Arbitration Act (FAA). Arbitration replaces the right to trial by jury or to participate in a class action. Arbitrators may award damages and relief similar to those awarded by a court.

Exceptions

This arbitration agreement does not preclude you or Americ LLC from:

  • Bringing an individual action in small claims court.

  • Pursuing enforcement actions through applicable regulatory agencies.

  • Seeking injunctive relief in court.

  • Filing intellectual property claims in court.

Arbitrator and Rules

Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Dispute Resolution Procedures and Supplementary Procedures for Consumer-Related Disputes. For more details, visit www.adr.org or call 1-800-778-7879.

Notice of Arbitration

To initiate arbitration, send written notice of the dispute to:

Your notice should describe the dispute and the relief sought. Parties must attempt resolution in good faith within 30 days before commencing arbitration.

9. Class Action Waiver

You and Americ LLC agree to resolve disputes on an individual basis. Class actions, consolidated claims, or representative proceedings are not allowed.

10. Modification of Terms

If Americ LLC modifies this arbitration clause, you may reject the change within 30 days by notifying us in writing.

11. Severability

If any provision of these Messaging Terms is deemed unenforceable, the remaining terms shall remain in full force.
